A high percentage of commercial disputes settle prior to court or arbitration. Usually, this follows the passage of many months (or years) with associated legal and personal costs throughout this passage of time.

For this reason, the statement: “settle now or settle later” is worth bearing in mind.

Mediation enhances the negotiation and bargaining process, focusing on a settlement that usually requires compromise on the part of each party to the dispute. Being a “without prejudice” process, the parties respective rights and disclosures are treated in the highest confidence in the event the mediation does not settle some or all of the dispute.

Statistics from the United Kingdom claim 92% of disputes referred to a particular mediation service settle by way of mediation whether on the day or shortly thereafter.

Even if the mediation itself is not successful, parties usually leave mediation with a clearer understanding of the other party’s motivations, position and issues in dispute.
