Wills & Estates Mediation

The tragedy of losing a family member is only compounded by the tragedy of a dispute over inheritance.

Estate litigation is often extraordinarily emotionally charged litigation concerning family members who feel unacknowledged or disentitled from the estate of their passed relative.

Sadly, this litigation often enters the Court system, straining already strained relationships - sometimes indefinitely, and using up the precious resources of the estate.

Wills and Estates mediation is an alternative dispute resolution process that often resolves estate disputes and retains relationship between the parties.

As a Nationally Accredited Mediator, my mediation services include provision of wills and estates mediations to include disputes between estate trustees and beneficiaries, persons appointed as powers of attorneys, charitable beneficiaries, and family members.

This less-adversarial and less confrontational approach to dispute resolution can often preserve more of the estate, and preserve relationships.

As mediator, my goal is to assist parties:

  • detail strategies for positive outcomes of their family dispute;

  • ensure the mediation is conducted respectfully, that parties are listened to and given the opportunity to speak; and,

  • discuss pragmatic ways to preserve relationships.

The greatest benefit of mediation is that it allows the parties of dispute to control the outcome of the dispute - taking ownership over the terms of settlement.
